Welcome to NKENGNETWORK. These Terms of Service ("Terms") govern your use of our platform, website, and services. By accessing or using NKENGNETWORK, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing and using NKENGNETWORK, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services. Your continued use of the platform constitutes acceptance of any updates to these terms.
2. Use of Service
You may use our service only for lawful purposes and in accordance with these terms. You agree not to use the service in any way that violates applicable local, national, or international law or regulation. Prohibited conduct includes, but is not limited to, infringing intellectual property rights, distributing malware, sending unsolicited communications, attempting to gain unauthorized access, and interfering with the proper functioning of the platform.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
4. Subscriptions and Payment Terms
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change our fees with 30 days' notice. Failed payments may result in service suspension. Taxes, where applicable, are added to your invoice based on your billing address.
5. Content and Intellectual Property
You retain ownership of content you submit to the platform. By posting content, you grant NKENGNETWORK a worldwide, non-exclusive, royalty-free license to host, store, use, display, and process that content for the purpose of operating our services. You represent that you have all necessary rights to the content you submit and that it does not violate any third-party rights.
6. Acceptable Use Policy
You agree not to: upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; impersonate any person or entity; collect user data without consent; or use automated systems to access the service in a manner that sends more requests than a human reasonably could. Violations may result in content removal or account termination.
7. Third-Party Services
Our platform integrates with third-party services (payment processors, hosting providers, social networks, etc.). We are not responsible for the practices of these third parties. Your use of third-party services is subject to their respective terms and privacy policies.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for temporary outages, maintenance downtime, or disruptions caused by events beyond our control. We may modify, suspend, or discontinue features at any time with reasonable notice.
9. Limitation of Liability
NKENGNETWORK shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the service. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless NKENGNETWORK and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights.
11. Governing Law and Disputes
These terms shall be governed by the laws of the Republic of Cameroon. Any disputes shall be resolved through binding arbitration in Yaoundé, Cameroon, unless you and NKENGNETWORK agree otherwise in writing. You and we agree that any dispute resolution will be on an individual basis (no class actions).
12. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page and, where appropriate, by email. The 'Last updated' date at the top reflects the most recent revision. Your continued use of the service after changes take effect constitutes acceptance.
